These Terms of Service (“Terms”) govern your use of the NeverMiss website and services provided by NeverMiss LLC (“NeverMiss”, “we”, “us”, or “our”). By using our website or services, you agree to these Terms.

1. The service

NeverMiss provides missed-call text-back, Google review automation, and lead follow-up messaging for home-service businesses, delivered through our website and mobile applications. We may modify, suspend, or discontinue any part of the service at any time.

2. Accounts and acceptable use

You must provide accurate information when creating an account and keep it up to date.
You are responsible for activity under your account.
You agree not to misuse the service, including sending unlawful, harassing, or unsolicited messages, or attempting to disrupt the service.
You represent that you have the necessary rights and consents to message your customers through our service, and that you will comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines.

3. SMS program terms

Program description: By providing your mobile number to NeverMiss — for example by joining our waitlist, creating an account, or otherwise opting in — you agree to receive recurring automated text messages from NeverMiss LLC, which may include missed-call follow-ups, review requests, lead follow-up messages, account notifications, and launch updates.

Frequency: Message frequency varies based on your use of the service.
Cost: Message and data rates may apply as determined by your mobile carrier.
Opt out: Reply STOP to any message to cancel. You will receive a confirmation message and will not receive further texts unless you opt in again.
Help: Reply HELP to any message for help, or contact us at hello@trynevermissapp.com.
Consent not required: Consent to receive texts is not a condition of purchase.
Carriers: Participating carriers are not liable for delayed or undelivered messages.

4. Pricing and payment

Current pricing is shown on our website or in the app. Paid plans are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except as required by law.

5. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual property

The NeverMiss name, logo, website content, and software are the property of NeverMiss LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute them except as expressly permitted.

7. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, message delivery, or any particular business results.

8. Limitation of liability

To the maximum extent permitted by law, NeverMiss LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability will not exceed the amounts you paid to us in the twelve (12) months preceding the claim.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in York County, Pennsylvania.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Continued use of the service after changes take effect constitutes acceptance.
